1. General information only
The content on this site is provided for general information. While we take reasonable care to keep it accurate and current, we do not warrant that it is complete, accurate, current or free from error, and we may change it at any time without notice. Nothing here is professional advice of any kind, and you should not treat it as a substitute for advice suited to your own circumstances.
2. Fresh produce varies
We sell fresh food, not manufactured goods. Product photographs are illustrative and were taken of a different item than the one you will receive. Size, colour, shape, ripeness, blemishing and eating quality vary naturally between growers, between weeks and between individual pieces, and seasonal conditions affect all of them.
Weights, counts and dimensions are approximate and are given as a guide. Where an item is sold by unit — a box, tray, bag or punnet — the quantity inside may vary slightly from the description. None of this displaces your rights under the Australian Consumer Law, which are set out in our Terms and Conditions, or your ability to request a refund for a genuinely poor quality or missing item.
3. Allergens, food safety and health
Ingredient, allergen, origin and nutritional information is supplied to us by the growers and stallholders who produce and pack the goods. We pass it on in good faith but cannot independently verify it. Produce is handled in market environments where nuts, gluten, dairy, seafood and other allergens are present, so we cannot guarantee any item is free from cross-contamination.
If you have a food allergy, intolerance or medical condition, check the packaging on arrival and do not rely solely on what this site displays. Nothing on this site is medical, nutritional or dietary advice. Wash fresh produce before eating and refrigerate perishable items promptly on delivery.
4. Prices, availability and the live rounds
Prices are set for a single market round and apply only during that round. They are not an ongoing offer and will differ from one round to the next. Comparison prices attributed to major supermarkets are indicative only: they are recorded at a point in time, may not reflect that retailer’s current price, promotion, pack size or state-based pricing, and are not a representation about any other retailer’s business.
Stock levels shown during a round are live and change second by second. Displayed availability is not a guarantee that an item is still available, and an item may sell out between the moment you see it and the moment you submit your order.
Livestream content is unscripted and broadcast in real time. Opinions expressed by hosts, stallholders, growers or other participants are their own, are not endorsements or representations by us, and are not verified before or during broadcast. Comments and reactions posted by other viewers in the chat are the responsibility of the people who posted them.
5. Site availability
We do not warrant that this site will be available uninterrupted or error-free, that defects will be corrected, or that the site or the server hosting it is free of viruses or other harmful components. Live video depends on third-party streaming infrastructure and on your own internet connection, and may drop out, buffer or fail. Installing this site as an app on your device gives limited offline access to previously loaded pages only; that cached content may be out of date and cannot be relied on for prices, stock or round times.
6. Third-party links and content
Where we link to another website, we do so for convenience. We do not control those sites, do not endorse them, and are not responsible for their content, their products or their privacy practices. Follow them at your own risk and read their own terms.
7. Limitation of liability
To the maximum extent permitted by law, and subject always to the Australian Consumer Law guarantees that cannot be excluded, we exclude all liability for any loss or damage arising from your use of, or reliance on, this site or its content — including indirect or consequential loss, loss of profit, loss of data and business interruption — whether that loss arises in contract, negligence or otherwise. Our liability for a breach of a non-excludable guarantee is limited as described in our Terms and Conditions.

All content on this site is protected by the Copyright Act 1968 (Cth) and, where applicable, by copyright laws in other countries. Unless we say otherwise, we own or are licensed to use everything on this site, including:
- the text, headings, product descriptions, editorial copy and help content;
- the design, layout, styling, look and feel of the site and its apps;
- the underlying software, source code, database structure and the compilation and arrangement of the data in it;
- photographs, illustrations, icons and graphics we have created or commissioned;
- all livestream broadcasts, recordings, highlights and audio produced for or by us; and
- our logos, wordmarks, brand names and get-up.
9. Trade marks
“Live At The Markets”, the Live At The Markets logo, the “Live at …” market names and logos used across our franchise sites, and our associated brand elements are trade marks of Live At The Markets Pty Ltd or are used by us under licence — whether or not they are registered. You may not use any of them, or any mark confusingly similar to them, without our prior written permission. In particular you may not use them in a business name, domain name, social media handle, app name, advertising, metadata or search keywords.
Trade marks belonging to other people that appear on this site — including grower and stallholder branding, market operators’ marks, payment brands and the names of retailers used in price comparisons — remain the property of their respective owners. Their appearance here does not imply any affiliation with, sponsorship by, or endorsement from those owners.
10. What you may do
You may view this site, and print or download a copy of a page, for your own personal, non-commercial use — for example, keeping a copy of your invoice, or saving a recipe idea. You must keep all copyright and other proprietary notices intact on anything you copy. The Copyright Act 1968 also permits certain fair dealing uses, such as reporting the news or criticism and review, and nothing here limits those.
11. What you may not do
Without our prior written permission, you must not:
- reproduce, republish, distribute, sell, licence or commercially exploit any part of this site or its content;
- copy, mirror, frame or present our content as if it were your own or as part of another service;
- use any automated means — scraping, crawling, harvesting, bots or similar — to extract our product data, prices, images or shopper content, or to build or train a dataset or product from them;
- extract or re-use a substantial part of our product or pricing database, or systematically re-use insubstantial parts of it;
- copy, decompile or reverse engineer our software, or attempt to derive its source code;
- record, re-broadcast, download, edit or publish any part of a livestream or its recording;
- remove, obscure or alter any copyright, trade mark or attribution notice; or
- register or use any domain name, business name or account name that incorporates or imitates our brand names.
We reserve all rights not expressly granted. Nothing on this site grants you any licence in our intellectual property by implication, estoppel or otherwise.
12. Content you contribute
When you post a chat message during a live round, or upload a photo with a refund request, you keep ownership of it. You grant us a non-exclusive, royalty-free, worldwide licence to use, store, reproduce and display that content for the purpose of operating the service — which includes showing your chat message to other viewers of that round, and reviewing your photo to assess your refund. You confirm you have the right to give us that licence and that the content does not infringe anyone else’s rights.
13. Reporting an infringement
If you believe something on this site infringes your copyright or other rights, tell us at our email address or through our support form. Include a description of the work, where on our site it appears, and your contact details. We investigate every report and will remove infringing material where a claim is made out.
14. Requesting permission
Media, partners and anyone else wanting to use our content, footage or brand assets should contact us at our email address, or lodge a media enquiry through the support form. We are generally happy to help with genuine coverage.
